Mary C. Azzaretto holds primary responsibility for the firm’s appellate practice including preparation of appellate briefs and oral argument in various state and federal courts of appellate jurisdiction. Areas of practice include all facets of New York State and Federal civil litigation, including premises liability, auto casualty claims, labor law claims, products liability, intentional torts, workers compensation, no-fault claims, insurance law, third-party subrogation actions and civil rights litigation.
Decision Of Interest
Mary C. Azzaretto has successfully argued various issues on appeal relating to lack of notice, open and obvious conditions, trivial defects, defense and indemnification, out-of-possession landowners, discrimination, labor law §200, 240 and 241 violations, the relation-back doctrine, alleged unlawful detention, workers compensation as a bar to civil recovery, and property damage. Of particular note the decision in the case of Schulmanv. Gap established a new precedent in the Appellate Division, First Department, as to liability for conditions that are both open and obvious and not inherently dangerous.
